Welcome to PER Miami Exotic Rentals. We're thrilled you're here, and we want your experience with our cars to be as memorable as it deserves to be. Before you book, please take a few minutes to read through these Terms of Service ("Terms"). They explain how renting from us works, what we expect from you, and what you can expect from us.

These Terms apply to your use of our website (www.permiamiexoticrentals.com), our booking process, and our rental services. They work together with our Vehicle Rental Agreement (the contract you sign at pickup), which contains the full legal terms of your rental. If anything in these Terms conflicts with the Vehicle Rental Agreement, the Vehicle Rental Agreement controls.

By using our website, making a reservation, or signing the Vehicle Rental Agreement, you agree to these Terms. If you don't agree, please don't proceed with a booking.

1

Who Can Rent

To rent one of our vehicles, you must:

  • Be at least 18 years old. Renters aged 18 to 20 go through enhanced review, which may include a driving-record check, insurance verification directly with your carrier, a higher security deposit, or limits on which vehicles you can rent. They may also be charged a Young Renter Fee of up to 20% of the rental subtotal, shown in your quote before you book.
  • Hold a valid, unexpired, unrestricted driver's license issued by a U.S. state or recognized foreign jurisdiction (no suspensions, revocations, or major restrictions). If your license isn't in English, bring an International Driving Permit or official translation if we ask for one.
  • Carry insurance that meets our requirements (see Section 5).
  • Provide a valid credit or debit card in your name, with enough available funds for the security deposit and any incidental charges. You can pay the rental itself another way (see Section 3.4).
  • Pass our identity verification process at pickup.

We reserve the right to verify your driving record and license status at any time and to decline or cancel a rental if verification doesn't pass. We may also decline service for any other lawful reason at our discretion.

2

Booking Your Rental

2.1How Reservations Work

A reservation is confirmed only when (1) you receive written confirmation from us and (2) your booking deposit has been processed. Until both happen, the vehicle is not held for you.

We do our best to deliver the exact vehicle you reserve, but on rare occasions a mechanical issue, prior damage, or other circumstance beyond our control may require us to substitute a comparable vehicle or cancel. If that happens, we'll let you know as soon as possible and refund any prepaid amounts as described in Section 4.

2.2Booking Deposit

A $250 non-refundable booking deposit is required to secure your reservation. The deposit is applied to your total rental balance when the rental proceeds. If you cancel, no-show, or fail identity verification at pickup, the booking deposit is forfeited.

2.3Authorized Driver Only

Only the person named as Renter on the Vehicle Rental Agreement may operate the vehicle. We don't permit additional drivers unless they're expressly named in a written Additional Driver Addendum signed by us, you, and the additional driver before they drive. Additional drivers must meet every requirement in Section 1, and an additional driver fee may apply. Letting anyone else drive — even briefly — is a serious breach of your agreement, voids any protections, and makes you fully liable for everything that follows.

2.4Extending Your Rental

Want more time? Contact us before your scheduled return time. An extension only counts once we approve it in writing (a text or email is fine) and you pay for the extra time, including fees and taxes. Your insurance must also stay in effect for the extended period. Extra days are charged at your daily rate and mileage allowance unless we agree otherwise. Keeping the car past your return time without an approved extension is a late return.

3

Pricing and Charges

3.1What You'll Pay

Your rental quote covers the daily rate, mileage allowance, and any delivery fees we agreed on. Beyond that, you may also be charged for:

  • Sales tax (6% Florida state tax plus any county surtax)
  • Florida rental car surcharge: $2 per day or part of a day, required by section 212.0606, Florida Statutes
  • Young Renter Fee: up to 20% of the rental subtotal for renters under 21, shown in your quote
  • Additional driver fee, if you add an approved driver
  • Delivery and collection fees, quoted when you book. If you're not available within 30 minutes of a scheduled delivery, we may treat it as a no-show or charge another delivery fee to reschedule.
  • Security deposit: $1,500 minimum held at pickup and released after return (see Section 3.3)
  • Mileage overage at the per-mile rate stated in your Rental Agreement
  • Late return fee: $150 per hour or partial hour past your scheduled return time, capped at two times the daily rate for each 24 hours late
  • Refueling fee: actual cost of fuel plus a $100 service fee if the vehicle isn't returned with a full tank of premium 91-octane fuel
  • Cleaning fee: $250 to $1,500 depending on condition (we don't charge for normal use — only for excessive dirt, sand, pet hair, food residue, bodily fluids, or similar)
  • Smoking/vaping reconditioning: minimum $1,000, up to actual reconditioning cost
  • Toll, parking, and citation pass-through: actual amount plus a $10 administrative fee per item. We never charge a daily toll-program fee on days you don't use a toll road.
  • Off-location return fee: at least $90 plus our actual recovery costs if you return the vehicle somewhere other than the agreed return point without prior approval
  • Telematics-related fees as described in Section 7
  • Damage, loss, and theft charges as described in Section 8
  • Other charges expressly authorized in your Vehicle Rental Agreement

3.2Payment Authorization

When you book and sign our Payment Authorization, you authorize us to charge your card on file, and to apply any cash, Zelle or Venmo payment or deposit, for the charges above. That includes tolls, citations, fuel and mileage identified after you return the vehicle.

Damage works differently. Before we charge your card for damage, diminished value or loss of use, we'll send you a written notice with photos and a repair estimate. You'll then have 10 business days to send us your insurance information, get your own estimate, or dispute it. We'll charge your card for damage only with your written consent to the amount, as a separate transaction. If you don't consent, we'll work through your insurer or pursue the amount directly (see Section 8).

We don't claim that this authorization is "irrevocable" or that it overrides your card-network rights — those rights are protected by federal law and card-network rules, and nothing here changes that. What we do ask is that if you have a billing concern, you contact us first so we can sort it out (see Section 9).

3.3Security Deposit

We collect a security deposit by hold or charge on your card at pickup. Within 10 business days after you return the vehicle, we'll release the unused portion or send you an itemized list of what we applied. After we release it, your card issuer controls the timing, typically 5–10 business days. If we agree in writing to take your security deposit in cash, Zelle or Venmo, we hold it as a deposit and return the unused portion within 10 business days by the same method (cash deposits are returned by check unless you agree otherwise). If your card can't cover the security deposit at pickup, we may decline to release the vehicle, and refunds follow Section 4.

3.4Payment Methods

We accept credit cards, debit cards, cash, Zelle and Venmo for rental charges. Zelle and Venmo payments must come from an account in your name, or from a third-party payer we've approved, and must go to our business account. We'll confirm our payment details to you in writing — never send money to any other account. Even if you pay the rental another way, a credit or debit card in your name must stay on file for the security deposit and any charges after return, unless we agree otherwise in writing. Anyone else who pays for your rental must be approved by us, sign our Payment Authorization, and is responsible along with you for any amounts owed.

4

Cancellations, Refunds, and Rescheduling

We get it — plans change. Here's how cancellations work, in plain terms:

4.1If You Cancel

  • 24+ hours before scheduled start: Booking deposit forfeited. Rental balance fully refundable.
  • Within 24 hours of scheduled start: Booking deposit forfeited. No refund of rental balance.
  • No-show (you don't appear at pickup): Booking deposit forfeited. No refund of rental balance.
  • Failed ID verification at pickup (not cured within 24 hours): Booking deposit forfeited. No refund of rental balance.

The security deposit, if already collected, is fully refundable in all cancellation scenarios.

4.2Rescheduling

If you need to reschedule, contact us as soon as possible. At our discretion, we may apply your booking deposit as credit toward a rescheduled rental within 90 days of the original date, subject to vehicle availability. Rescheduling is not guaranteed and depends on availability and circumstances.

4.3Early Returns

We don't refund early returns. The full rental rate is earned for the term you reserved, since the vehicle is held exclusively for you during that period.

4.4If We Cancel

If we can't provide your reserved vehicle because of a mechanical issue, prior damage, or another circumstance outside your control, we may offer you a comparable substitute. If you decline it, or we can't offer one, we'll refund all prepaid amounts (including the booking deposit) within 5–10 business days. We're not liable for incidental costs you may have planned around the rental (flights, hotels, events, etc.), and we strongly recommend travel insurance for trips built around a rental.

4.5Non-Refundable Items

These items are non-refundable once incurred:

  • Booking deposit (except as described in Section 4.4)
  • Delivery and pickup fees once service has been provided
  • Payment processing fees, where lawful and disclosed before you pay
  • Rental fees or daily rates once the trip has started.
  • Charges incurred during the rental (late fees, fuel, tolls, citations, cleaning, damage, etc.)

4.6Refund Processing

Eligible refunds go back to your original payment method within 5–10 business days. Posting times after that are up to your card issuer or bank, and we can't speed up their internal processing. Cash payments are refunded by check unless you agree to another method.

4.7If We Need the Car Back Early

We may ask you to return the car early because of a manufacturer safety recall, a legal or law-enforcement requirement, a hurricane or tropical storm (see Section 18), or a serious breach of your Rental Agreement. We'll give you a reasonable time and place to return it. Unless the early return is because of your breach, we'll refund the rental rate for unused full days.

5

Insurance

You must carry insurance that is primary to any coverage we have and that provides at least:

  • $100,000 / $300,000 bodily injury liability (per person / per occurrence)
  • $100,000 property damage liability
  • Comprehensive and collision coverage with a deductible no higher than $1,000
  • Coverage that extends to high-value or exotic rental vehicles of the car's value (please confirm with your carrier — many standard policies don't automatically cover six-figure vehicles)
  • Personal injury protection (PIP) if you're a Florida resident or your policy is a Florida policy

We accept three kinds of coverage, verified before pickup:

  1. A U.S. personal auto policy in your name, or listing you as a driver.
  2. A rental-specific or exotic-vehicle policy bought before pickup from an insurer we accept, naming you and covering the specific car for your full rental. We must approve it in writing before pickup.
  3. A corporate or commercial auto policy, shown by a certificate of insurance with hired-auto liability and physical-damage coverage, listing you as a covered driver.

Credit-card rental benefits don't replace this coverage, but you can use them as extra coverage.

Florida notice (section 627.7263, Florida Statutes): The valid and collectible liability insurance and personal injury protection insurance of any authorized rental or leasing driver is primary for the limits of liability and personal injury protection coverage required by ss. 324.021(7) and 627.736, Florida Statutes.

We may verify your coverage directly with your carrier and may require you to be named as primary insured for the rental term. If your insurance lapses or is cancelled during the rental, you must notify us immediately.

We do not currently offer a Loss Damage Waiver (LDW) or Collision Damage Waiver (CDW). You are fully responsible for damage to or loss of the vehicle, as detailed in your Vehicle Rental Agreement.

6

How You Can (and Can't) Use the Vehicle

6.1Where You Can Drive

The vehicle may be driven only on paved public roads in the continental United States, and the Florida Keys are fine. No Mexico, no Canada, and no shipping the car: it can't go on a ferry, boat, car carrier, train or plane without our written permission. Taking the car outside these limits is a serious breach of your Rental Agreement.

6.2Mileage

Each rental includes a daily mileage allowance specified in your Vehicle Rental Agreement. Miles over the allowance are charged at the per-mile rate stated there. We record the odometer at pickup and return.

6.3What You Can't Do With the Vehicle

These uses are strictly prohibited and will void your protections, terminate your rental, and make you liable for everything that follows:

  • Operating impaired — alcohol, marijuana (regardless of state legality), other controlled substances, or impairing medications
  • Letting anyone else drive who isn't named in the Rental Agreement or an approved Additional Driver Addendum
  • Hire or commercial transport — Uber, Lyft, DoorDash, deliveries, or any for-hire service, or carrying more passengers than there are seat belts
  • Racing or track use — racing, speed contests, street takeovers, burnouts, drifting, time trials, autocross, driving schools, or any closed-course operation
  • Organized driving events — track days, car meets, cars-and-coffee, group drives, parades, club events, or similar events without our prior written permission
  • Beaches, sand and off-road — beaches, sand, boat ramps, unpaved roads, or any surface not intended for ordinary passenger-vehicle use
  • Flood water — driving through flooded roads or standing water, or keeping the car in an area under an evacuation order after we've asked you to move it
  • Towing or pushing any other vehicle, trailer, or object
  • Criminal activity — transporting controlled substances, contraband, illegal weapons, or anything that would violate human-trafficking laws
  • Hazardous materials — fireworks, flammable liquids, or other hazardous materials beyond ordinary personal quantities
  • Reckless driving, or overloading the vehicle beyond manufacturer specs
  • Hand-held phone or device use while driving, in violation of Florida law
  • Leaving the car unattended with the engine running or the keys inside
  • Smoking, vaping, or any combustible/aerosolized substance inside the vehicle (this includes hookah pens, vape pens, cannabis vapes — anything that produces vapor or smoke)
  • Pets — service animals are always welcome
  • Tampering with GPS, OBD-II, telematics devices or cameras
  • Modifications of any kind — temporary wraps, decals, magnetic signs, window tint, adhesive- or suction-mounted accessories, performance tuning, ECU modifications, or aftermarket parts
  • Commercial or paid content creation — paid photoshoots, music videos, ads, films, brand promotion, or compensated content, without our written permission and a commercial-use fee. Personal social media use is fine, as long as no one is paying you and no commercial sponsor is featured.

6.4Valet Parking

You're welcome to use valet parking, but if a valet damages the vehicle, you're responsible — not us. We'll look to you for the full damage amount, and you can pursue the valet operator directly. We don't get involved in those claims.

6.5Fuel

The vehicle leaves with a full tank of premium 91-octane (or higher) fuel and should come back the same way. Regular gasoline, racing fuel, and additives are not allowed. If the tank isn't full at return, we charge actual refill cost plus a $100 service fee.

6.6Child Passengers

You're responsible for securing every child in a car seat or seat belt as Florida law (section 316.613, Florida Statutes) and the car's manufacturer require, including front-seat airbag warnings. We don't provide car seats unless we agree in writing, and damage from installing one is your responsibility.

7

GPS, Telematics, and Driving Behavior

Every vehicle in our fleet has GPS and OBD-II telematics that record location, speed, acceleration, braking, gear selection, engine RPM, and similar driving data. We use this information to locate vehicles, respond to emergencies, verify compliance with the Rental Agreement, investigate damage or mechanical failures, assist law enforcement when required, and protect our legal rights.

7.1Driving Behavior Limits

The following will result in consequences:

  • Tampering with, removing, or disabling any tracking or telematics device
  • Tampering with, removing, or impeding vehicle cameras
  • Exceeding speeds greater than 90 mph
  • Repeated hard acceleration or hard braking

We'll give you one (1) warning in total, by text or email, across all categories. After that warning, any further violation of any category lets us end your rental early, recover the vehicle at your expense, and keep your security deposit as liquidated damages for the added wear, inspection and risk. Any actual damage to the car is charged separately under Section 8.

7.2Speeds Over 100 mph

If telematics records a speed of 100 mph or higher, you'll be charged up to $500 per occurrence based on our reasonable estimate of accelerated wear, increased insurance exposure, and inspection costs. You're also responsible for a full mechanical and safety inspection and any resulting repairs. The $500 cap applies only to the per-occurrence fee — actual damage from such operation is governed by the damage liability section of your Vehicle Rental Agreement.

8

Damage, Loss, and Theft

You're responsible for the vehicle from pickup to return, whatever the cause — including theft, vandalism, flood, hail and wind — except as limited by Florida law. We don't include LDW or CDW in our rates.

This includes:

  • All cosmetic damage — chips, scratches, curb rash, wheel damage, tire damage, windshield damage, interior damage, and undercarriage damage. There's no wear allowance.
  • Repair costs at OEM and certified-specialty rates appropriate to the make and model
  • Total loss — the car's pre-loss fair market value, less salvage, if it can't be repaired
  • Theft — the car's pre-theft fair market value if it's stolen and not recovered
  • Diminished value — the loss in resale value following structural, paint, or significant cosmetic repair, calculated by an independent licensed appraiser
  • Loss of use — 70% of the daily rental rate for up to 30 days while the vehicle is out of service
  • Incidental losses — towing, storage, recovery, lost or damaged keys and key fobs, appraisal, and reasonable administrative costs

How we bill damage. We'll send you a written damage notice with photos and a repair estimate — within 10 business days of return for anything found at the return inspection. You then have 10 business days to send us your insurance information, get your own estimate, or dispute it. We'll charge your card for damage only with your written consent to the amount. Otherwise, we'll work through your insurer or pursue the amount directly. We may claim damage discovered within 30 days after return, and we keep our right to pursue damage discovered later, within the statute of limitations.

Your insurance claim. Please report any loss to your insurer promptly. If you don't within 48 hours, you authorize us to open the claim with your insurer and have benefits paid directly to us. Anything your insurer doesn't pay, including your deductible, remains your responsibility.

If the car breaks down. If a mechanical failure that isn't caused by misuse makes the car unusable, stop driving and call us. We'll provide a comparable replacement as soon as reasonably practicable, or end the rental and refund unused full days and the time the car was unusable.

If something happens. Notify us within four (4) hours (or as soon as reasonably possible). File a police report where Florida law requires one, and always for theft, vandalism, hit-and-run or injury. Send us any legal papers you receive about the incident within 24 hours, and cooperate fully with our investigation and any insurance claim. The full terms are in Section 16 of your Vehicle Rental Agreement.

9

If You Have a Billing Concern

If something on your bill doesn't look right, please contact us first — before disputing the charge with your card issuer. Most billing questions are easily resolved with a quick conversation, and we're committed to working with you in good faith.

Contact us at:

We ask that you give us 30 days to investigate and respond before starting a chargeback. Amounts that remain unpaid may be subject to collection as described in your Vehicle Rental Agreement.

We won't pretend you can't dispute charges with your card issuer — federal law and card-network rules give you that right, and nothing here takes it away. But the fastest, easiest, and best path for everyone is to call us first.

10

Cameras in the Vehicle

Our vehicles are equipped with dashboard-facing and interior cabin-facing cameras. The cameras do not record audio. They're there to protect the vehicle, monitor for unauthorized drivers, verify compliance with the Rental Agreement, and document the condition of the vehicle during the rental. Please let your passengers know the cabin is video-recorded.

Camera footage is retained for up to 24 hours after rental return and then automatically overwritten, except in cases of accident, suspected damage, contract violation, insurance claim, or law-enforcement request, where we may retain it longer. You'll be notified if footage is retained beyond 24 hours.

While operating or occupying the vehicle, you have no expectation of privacy in areas the cameras can see. Tampering with or disabling a camera is a material breach. It counts as a violation under Section 7.1 and lets us end your rental, recover the vehicle and keep your security deposit as described there.

11

Recovery of the Vehicle

If you seriously breach the Rental Agreement, don't return the vehicle on time, trigger telematics-based termination, or a payment authorization fails, or if we reasonably suspect theft or abandonment, you authorize us (and our agents and recovery services, licensed where required) to locate the vehicle by GPS and recover it without a court order, as long as we don't breach the peace. We won't enter a locked garage or other closed structure without permission or legal process. You'll be responsible for the reasonable costs of recovery — towing, storage, locksmith, and recovery-agent fees. We'll let you know promptly after any recovery and will hold any personal property found in the car for 30 days.

This authorization is part of why we're able to keep our rates competitive on these vehicles. We rarely have to use it, but we have to be able to recover our property quickly when something goes wrong.

12

Limitation of Liability

To the fullest extent permitted by law, our total liability to you for any claim arising out of or related to your rental will not exceed the total rental charges you paid for that rental, and we're not liable for incidental, special, indirect, or consequential damages — things like lost wages, missed events, or trip cancellation costs. These limits don't apply to bodily injury or death caused by our negligence, to our gross negligence or willful misconduct, or to anything that can't be limited by law. We're not responsible for personal property left in or on the vehicle.

THE VEHICLE IS RENTED "AS IS." EXCEPT AS STATED IN THESE TERMS AND YOUR RENTAL AGREEMENT, INCLUDING OUR RESPONSIBILITY FOR MECHANICAL FAILURE, WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

13

Indemnification

You agree to defend, indemnify, and hold harmless PER Ventures LLC d/b/a PER Miami Exotic Rentals and its members, managers, officers, employees, agents, and affiliated entities from any claims, liabilities, losses, damages, costs, and expenses (including reasonable attorneys' fees) arising out of:

  • Your use of the vehicle
  • Your breach of these Terms or the Vehicle Rental Agreement
  • The acts or omissions of any person operating or occupying the vehicle during your rental
  • Any claim brought by a passenger or other occupant of the vehicle

This doesn't apply to the extent a loss is caused by our gross negligence or willful misconduct.

You represent that you'll inform passengers that the vehicle is rented and that riding in a high-performance vehicle carries inherent risks.

14

Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT OR PARTICIPATE IN A CLASS ACTION.

14.1Talk to Us First

Most disputes get resolved with a phone call. Before filing anything formal, please send us a written notice describing the issue and what you'd like us to do about it. We'll have 30 days to work it out informally.

14.2Binding Arbitration

If we can't resolve the dispute in those 30 days, any controversy or claim arising out of or relating to these Terms, your rental, or the vehicle — whether based in contract, tort, statute, or otherwise — will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in Miami-Dade County, Florida (or by video conference if we both agree), before a single arbitrator, with fees allocated under the AAA Consumer Arbitration Rules. Judgment on the award may be entered in any court of competent jurisdiction.

14.3Class Action Waiver

You and we both agree to bring claims only individually — not as a class plaintiff, class member, or representative. The arbitrator can't consolidate multiple parties' claims and can't preside over any class or representative proceeding.

14.4Exceptions

Either of us can still:

  • Bring an individual claim in small-claims court if it qualifies
  • Seek injunctive or equitable relief in court to protect intellectual property or recover the vehicle
  • We can also pursue collection actions in court for unpaid amounts

14.530-Day Opt-Out

You can opt out of the arbitration provisions in this Section 14 by sending us written notice within 30 days of signing your Vehicle Rental Agreement. The notice should include your name, address, rental agreement number, and a clear statement that you're opting out. Opting out doesn't affect any other part of these Terms.

Send the opt-out notice to:

PER Ventures LLC d/b/a PER Miami Exotic Rentals, 2125 Biscayne Blvd, Ste 204 #27804, Miami, FL 33137

14.6Court Venue for Anything Else

For any claim that isn't subject to arbitration, both parties consent to the exclusive jurisdiction of the state and federal courts in Miami-Dade County, Florida. TO THE EXTENT PERMITTED BY LAW, YOU AND WE EACH WAIVE ANY RIGHT TO A JURY TRIAL IN THOSE CASES. In any case or arbitration to enforce these Terms or the Rental Agreement, the winning party may recover reasonable attorneys' fees and costs, including on appeal, unless the arbitration rules provide otherwise.

15

Florida Disclosures

Insurance primacy (section 627.7263, Florida Statutes). The valid and collectible liability insurance and personal injury protection insurance of any authorized rental or leasing driver is primary for the limits of liability and personal injury protection coverage required by ss. 324.021(7) and 627.736, Florida Statutes.

Failure to return (section 812.155, Florida Statutes). Failure to return rental property or equipment upon expiration of the rental period and failure to pay all amounts due (including costs for damage to the property or equipment) are evidence of abandonment or refusal to redeliver the property, punishable in accordance with section 812.155, Florida Statutes. If you don't return the car, we may send a written demand by certified mail or tracked courier to the address you gave us. Not returning it within 5 days after that demand may be used as evidence under that statute.

Failure to redeliver a hired vehicle (section 817.52(3), Florida Statutes). Abandoning a hired vehicle, or willfully refusing to redeliver it as agreed, without our consent and with intent to defraud, is a third-degree felony.

Odometer tampering (section 817.52(4), Florida Statutes; 49 U.S.C. § 32703). Tampering with the odometer or any mileage-recording device, with intent to defraud, is a crime under Florida and federal law.

License records. As section 322.38, Florida Statutes, requires, we inspect your driver's license and keep a record of it.

Rental car surcharge. Florida requires a $2 per day surcharge on car rentals (section 212.0606, Florida Statutes). We collect it and list it separately with sales tax.

Cameras. Our in-car cameras record video only and never record audio or conversations.

Depending on where you live, you may have rights to access, correct, delete, or object to certain processing of your personal information. To exercise these rights, contact us using the information in Section 20.

16.9Children

Our services are not directed at anyone under 18, and we don't knowingly collect information from minors. If you believe we have collected information from a minor in error, please contact us.

16.10Changes to Privacy Practices

If we make material changes to how we handle personal information, we'll update this section and post the new effective date.

16.11Data Security

We store ID images, verification photos and payment details securely, limit access to staff who need them, and delete them on the schedule in Section 16.7. We never keep full card numbers or security codes from verification photos.

17

Identity Verification at Pickup

To protect both of us against fraud, we require the following at pickup:

  • Original driver's license for in-person inspection and photographic copy
  • A second form of government-issued photo ID (passport, state ID, or military ID)
  • The physical credit or debit card on file, photographed while you hold it, with all but the last four digits covered and the security code hidden
  • A photograph of you holding your driver's license next to your face
  • A signed pickup receipt confirming acceptance of the vehicle and authorization of the charges

By making a reservation and signing the Vehicle Rental Agreement, you consent to providing these materials and authorize us to use them for fraud prevention, identity verification, and as compelling evidence in any chargeback or dispute. If you can't or won't provide them at pickup, we may decline to release the vehicle, and the booking deposit is forfeited.

18

Force Majeure

Neither of us is liable for delays or failures caused by events beyond reasonable control — hurricanes and tropical storms, flooding and other severe weather, fires, mechanical failures not caused by you, governmental actions, civil unrest, pandemics, and supply-chain disruptions. If we can't deliver your vehicle because of one of these events, you choose either (1) a refund of prepaid amounts for the affected part of the rental, less the booking deposit, or (2) a credit for everything you prepaid, including the booking deposit, toward a rental starting within 90 days, subject to availability.

If a hurricane or tropical storm watch or warning, or an evacuation order, is issued where the car is, please follow our instructions. That may mean moving the car to covered parking away from flood-prone areas, or returning it early. If we ask for an early return for safety, we'll refund unused full days. Wind, flood and debris damage while the car is with you is still covered by Section 8, so please never drive through flood water.

General Provisions

19.1Modifications

We may update these Terms from time to time. The current version will always be posted at www.permiamiexoticrentals.com/tos with an updated "Last Updated" date. For reservations already confirmed, the Terms in effect at the time of booking apply. Continued use of our website or services after an update means you accept the updated Terms.

19.2Conflict with Rental Agreement

If anything in these Terms conflicts with the Vehicle Rental Agreement, the Vehicle Rental Agreement controls for matters relating to the rental itself. These Terms control for website use and pre-booking matters not addressed in the Rental Agreement.

19.3Severability

If any part of these Terms is found unenforceable, the rest stays in effect, and the unenforceable part will be reformed to the minimum extent needed to make it enforceable while preserving the original intent.

19.4No Waiver

If we don't enforce a particular provision on one occasion, that doesn't mean we waive the right to enforce it later.

19.5Assignment

You may not assign your rights or obligations under these Terms or the Rental Agreement without our prior written consent. We may assign ours without restriction.

19.6Entire Agreement

These Terms, together with the Vehicle Rental Agreement and every addendum we sign with you (including the Payment Authorization, Camera Disclosure, Young Renter, Additional Driver, Insurance Verification, Pickup and Return Receipt, and Damage Charge Notice and Consent forms), are the entire agreement between us regarding your rental and supersede any prior agreements or understandings.

19.7Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. The Federal Arbitration Act governs Section 14.

19.8Electronic Signatures

These Terms and the Rental Agreement may be signed and delivered electronically. Electronic signatures have the same effect as handwritten signatures under the federal E-SIGN Act (15 U.S.C. § 7001 et seq.), the Florida Electronic Signature Act (sections 668.001–668.006, Florida Statutes), and Florida's Uniform Electronic Transaction Act (section 668.50, Florida Statutes).
